Contractor - Sub-contractor Arrangements
The construction industry has long been a target for Employer Compliance Reviews by HMRC. These reviews typically start as routine enquiries of employee's PAYE, inspecting wages, NIC, expenses and benefits, but quickly moves onto a review of the contractual arrangements of your sub-contractor workforce. Usually HMRC attempts to conduct an in depth investigation questioning your sub-contractors to ascertain the contractual relationship. If as the main contractor you have failed to put in place adequate contractual terms, this error could be catastrophic for your business. It is common for HMRC to claim that your sub-contractor workforce are really your employees and as such, you are liable for underpayment of the primary and secondary National Insurance contributions totalling 23.8% plus interest and penalties. The next question they will ask is how many years have you been operating in this manner. This type of enquiry can bankrupt the business.
